Asset Tokenization: A New Horizon in the Digital Age

What is Asset Tokenization?

Asset tokenization is the process of moving the representation of an actual physical asset (real estate, artwork, stocks, or real estate) to a digital token on the blockchain. Legal Framework for Asset Tokenization

Given the increase in the tokenization of assets, there is a need for a regulatory framework that provides the necessary protection and transparency for those who trade with these instruments. Until September 2020, the only regulation we had on the subject was the V European Directive on the prevention of money laundering, transposed into our legal system in 2021. From that date onwards, five European regulations appear, directly applicable in the Member States, which are going to regulate this matter.

These regulations include the Digital Operational Resilience Regulation (DORA), the eIDAS 2 Regulation, the Funds Transfer Information Regulation, the MiCA Regulation and the European Union Regulation on the pilot scheme for market infrastructures based on distributed ledger technology (DLT).
